As executor, administrator, or personal representative, Al Stam manages every aspect of the California probate process — from filing the initial Petition to Administer Estate and publishing the Notice of Petition to Administer Estate, through the four-month creditor period and final distribution — so that families can focus on healing rather than paperwork.

Our legal background ensures that court filings are accurate, deadlines are met, and creditors are properly noticed and resolved. Where applicable, Al Stam petitions for Independent Administration under the Independent Administration of Estates Act (IAEA) to streamline the process. When assets were inadvertently omitted from a trust, a Heggstad petition can often bring them into the estate without full probate. Following a will, Letters Testamentary are issued by the court; where no will exists, the estate passes by California intestate succession law and Letters of Administration are issued. When an individual loses the capacity to manage their own financial or personal affairs — due to Alzheimer’s disease, dementia, cognitive decline, a stroke, serious illness, or disability — a California court may appoint a conservator of the estate to act on their behalf. Al Stam serves as an independent, court-appointed conservator, managing the conservatee’s finances with the highest duty of care and full accountability to the probate court. California conservatorship law is governed by Probate Code §1800 et seq. and, for LPS conservatorships involving mental health, the Welfare & Institutions Code (Lanterman-Petris-Short Act). The process begins with a capacity declaration from a licensed physician, followed by a conservatorship petition reviewed by a court investigator. A temporary conservatorship may be established on an expedited basis where urgent protection is needed. Where a person’s needs are limited, the court may grant a limited conservatorship rather than a general one.

A Special Needs Trust (SNT) — also called a supplemental needs trust — is a carefully structured legal arrangement designed to improve the quality of life for a beneficiary with disabilities, without disqualifying them from means-tested government programs such as Medi-Cal, Supplemental Security Income (SSI), or Social Security Disability Insurance (SSDI). Improper distributions can breach SSI resource limits and trigger immediate loss of critical benefits. There are two primary types: a third-party SNT (funded by family, no Medi-Cal payback required) and a first-party SNT or d4A trust (funded with the beneficiary’s own assets, Medi-Cal payback required). A pooled trust (d4C) may also be appropriate. An ABLE account may supplement the SNT for day-to-day disability-related expenses.

A DPOA may be effective immediately or spring into effect only upon incapacity (a "springing" DPOA). Certain powers — called "hot powers" — such as the ability to make gifts or change beneficiary designations, require explicit authorization.
